1. Agreement
These Terms & Conditions govern your use of https://www.oregoncargocontainersllc.com and any order you place with Oregon Cargo Containers LLC("we," "us"). By placing an order or using the site, you agree to these terms. If you do not agree, please do not use the site or place an order.
2. Orders & quotes
Submitting an order through checkout is a request, not a binding contract. We review each order for availability, delivery feasibility, and final pricing, then send you a written quote/invoice. A binding sale is formed only when we confirm your order and you complete payment. We may decline or cancel any order at our discretion, including for pricing errors, unavailability, or inability to deliver to your location.
3. Pricing
Prices shown on the site and any on-screen totals are estimates and are subject to confirmation on your invoice. Delivery (freight) is quoted separately based on your location and is not included in the unit price. Applicable taxes are added where required. All prices are in US dollars.
4. Payment
We do not collect payment online. After we confirm your order we will email an invoice payable by bank transfer using the details provided. Unless otherwise agreed in writing, payment is due in full before delivery or release of the container(s). Title passes to you only upon receipt of full payment.
5. Delivery
Delivery dates are estimates. You are responsible for ensuring safe, legal, and adequate site access for the delivery vehicle, including firm, level ground and sufficient clearance. Additional charges may apply for redelivery, wait time, or special equipment required by site conditions. Risk of loss passes to you on delivery.
6. Container condition
Used containers are sold by grade (e.g. One-Trip, Cargo-Worthy, Wind & Water Tight). Used units show cosmetic wear such as surface rust and dents consistent with their grade. Wind & Water Tight units are guaranteed to be free of leaks at the time of sale. Photographs on the site are representative of the type and may not depict the exact unit delivered.
7. Custom builds, cancellations & returns
Custom-modified containers and made-to-order builds are non-cancellable and non-refundable once work has begun. For stock units, cancellation or return may be subject to a restocking fee and return freight. Contact us as soon as possible if you need to change or cancel an order.
8. Warranties & disclaimer
Except for any express guarantee stated for a unit's grade, containers are sold "as is" to the fullest extent permitted by law, and we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose.
9. Limitation of liability
To the maximum extent permitted by law, Oregon Cargo Containers LLC is not liable for indirect, incidental, or consequential damages, and our total liability for any claim will not exceed the amount you paid for the product or service giving rise to the claim.
10. Governing law
These terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Oregon.
11. Changes
We may update these terms from time to time. The version in effect when you place an order applies to that order. Continued use of the site constitutes acceptance of the updated terms.
